The service

5K Creative Studio is provided by La Porte B.V., Nieuwe Leliestraat 133, 1015 SN Amsterdam, Netherlands. KvK 82417865. VAT NL862463178B01. Contact hello@5k.agency or +31 20 681 1545.

These terms apply to accounts, previews and use of the studio. The Pro Purchase Terms govern paid subscriptions, plan limits, renewal, cancellation, refunds and commercial use; they take precedence if these pages conflict. Mandatory consumer rights always apply.

Your account

Provide accurate information and keep your password and recovery key private. One Pro subscription is for one named user. Contact support promptly if you suspect unauthorised access. We use email verification and require additional authentication for staff administration.

Your content and outputs

You retain your rights in uploaded images, copy and projects. You authorise us and our service providers to store and process them only to provide, secure and support the service. We do not acquire permission to publish your content for marketing.

Only upload material you are entitled to use and provide to the service. You may deliver lawfully created exports for personal and commercial client work. Cancellation does not revoke those output-use rights. Sample brand images are for preview/testing unless separately licensed; do not treat them as assets licensed for your advertising. You may not redistribute the studio software, fonts or source templates.

Review your output, including copy, crops and third-party rights, before publication. The Privacy Policy describes data handling. Contact us before uploading data requiring special regulatory protection or a separate data-processing agreement.

Responsible use and account restrictions

Do not upload unlawful or malicious material, access another account, evade payment controls, overload the service or interfere with other customers. Report security issues or unlawful content to hello@5k.agency with enough information for investigation; do not include passwords or unnecessary sensitive material.

We may restrict access where reasonably necessary to address abuse, security threats, unpaid subscriptions or legal obligations. Where lawful and safe, we explain the reason and how to request a review through support. A restriction does not automatically delete projects or override mandatory refund, access or data-protection rights.

Paid plans and withdrawal

Uploading and previewing are free. Finished downloads require a verified account and eligible Pro subscription. Pro is monthly; annual and Team plans are not offered at launch. Read the full plan, price including applicable tax and recurring-payment details before paying.

Consumers retain the initial 14-day full-refund withdrawal policy even after using Pro. Use Withdraw from a consumer contract, email or post. Ordinary cancellation stops the next renewal and normally keeps Pro available to the end of the paid month. See the Purchase Terms for full details.

Saved work, support and legal rights

Cloud storage and rendering limits are disclosed on the Pro plan. Download portable backups and completed files you need to keep. Project archiving hides a project; it does not erase the stored data. Pro cancellation is distinct from account closure or a data-erasure request.

We aim to reply to support within two business days, excluding Dutch public holidays. There is no promised uninterrupted uptime, but we retain our obligations to provide the contracted service, required security updates and legally required remedies.

Dutch law applies without depriving consumers of applicable mandatory protections or court rights in their country of habitual residence. Nothing here excludes liability that cannot lawfully be excluded. Material changes affecting existing paid rights follow the notice and remedy provisions in the Purchase Terms.

Who is responsible

La Porte B.V., Nieuwe Leliestraat 133, 1015 SN Amsterdam, Netherlands, is the controller for account, billing, support and service-security information. KvK 82417865; VAT NL862463178B01. Contact hello@5k.agency or +31 20 681 1545 for privacy questions.

What we use and why

We use your name, email, verification state and protected authentication/recovery records to provide and secure your account. If you choose email-code sign-in, we send a single-use code to your address. If Google sign-in is available and you choose it, Google provides your account identifier, name, email and verification information to sign you in; we do not request access to your Google files or email. We store project names, images, copy, settings, thumbnails and revisions when you save to the cloud. A requested server export also stores the render input, job and output. These activities provide the service you request under our contract.

We use an approximate country lookup of your IP address on our own server to show US-dollar pricing to visitors from the United States and euro pricing elsewhere. The lookup uses a downloaded country database; we do not send your IP address to that database provider. A short-lived signed price quote keeps the displayed currency consistent with checkout. We use session information, IP-related rate-limit records, access/error logs and staff audit records for our legitimate interests in preventing abuse, investigating faults and protecting customers. Support correspondence helps us respond to your request and resolve contractual issues.

We store Stripe customer, subscription, checkout, invoice and event identifiers, billing state, accepted terms, purchase confirmations and withdrawal/refund records to perform our contract, comply with legal and accounting obligations, and establish or defend claims. Stripe processes payment details; we do not store full card numbers.

Service providers and international processing

Hostinger provides hosting and server infrastructure; Titan provides email; Stripe provides payment, tax calculation and billing services. Necessary data is disclosed to the relevant provider for that purpose. Stripe may also process payment data as an independent controller under its own notice. We do not sell project or account data.

Provider processing can involve countries outside the EEA. Their data-processing terms describe applicable transfer safeguards and subprocessors. We do not promise that all processing is confined to the Netherlands. Contact us for information about safeguards applying to your data. See Hostinger’s DPA, Titan’s DPA and Stripe’s privacy notice.

When you provide personal data about clients or other people, make sure you have an appropriate basis and notice for that use. Contact us to arrange any required customer data-processing agreement before uploading such data on behalf of an organisation.

Retention and closure

Active account projects remain available within the disclosed limits. We retain saved projects for at least 90 days after Pro ends, subject to your deletion request or an overriding legal/security reason, and give at least 30 days’ email notice before routine cleanup. Cancelling Pro does not close your account or erase projects.

Completed export links remain available for at least 24 hours; older render inputs and outputs can be moved to a restricted archive. Archiving is not erasure. We review archived files and inactive records according to their continuing service, security and legal need.

Account closure and deletion requests enter a staff review queue. There is no instant automatic erasure on closure. We verify the request, identify records that can be erased, explain any exceptions and arrange the appropriate action, including backups and service providers. Restricted backups are kept for recovery; any applicable erasure must also be accounted for before a backup is restored to active use.

Core financial records generally must be retained for seven years; some tax records require longer under applicable law. We retain relevant legal-claim records for the applicable claim period and restrict their use. Other support and security records are retained only while needed to resolve the issue, operate securely or comply with law; the need is reviewed rather than promising an unimplemented automatic deletion date.

Your rights

Subject to applicable conditions, you may request access, correction, erasure, restriction, portability or object to processing based on legitimate interests. Contact hello@5k.agency from your account email where possible. We use proportionate identity checks and aim to respond within one month; any lawful extension will be explained. Never send passwords, recovery codes or full card details.

You can complain to the Autoriteit Persoonsgegevens or your relevant supervisory authority. If processing is based on consent, you may withdraw that consent without affecting earlier lawful processing. We do not use automated decision-making to make legal or similarly significant decisions about you.

Updates

We publish updates here and notify account holders of material changes where required. A new notice does not retrospectively authorise incompatible use of your work.

Cookies and local drafts

The studio uses essential account-session and short-lived sign-in cookies and browser storage for projects, preferences and recovery drafts. Guest Save stores images, copy and settings locally before sign-up so your work can return after registration or checkout. Clearing browser data can remove local-only work. Optional analytics and Pinterest advertising measurement are described below. Stripe’s hosted checkout and portal operate under their own notices.

Studio outcome reports

We use private aggregate counts of accounts created, first hosted Motion and Carousel exports and confirmed first Pro purchases to understand and improve the service. These counts use existing account and payment records and a minimal first-export record. Staff accounts are excluded. Publish receives totals and campaign labels, not customer names, email addresses, artwork, payment details or account identifiers.

If you accept analytics, a campaign-label cookie lasts for up to 30 days and can associate a new account and its first outcomes with the campaign used at signup. Campaign labels are retained in private reporting records for up to 180 days; they are not sent from account or editing pages to Google. Withdrawing consent removes the campaign cookie and stops future attribution; the next authenticated Studio request clears that account’s stored attribution. You can also contact us to request removal. Previously aggregated reports are not automatically erased.

Optional Google Analytics

With your permission, we use Google Analytics (Google tag G-RZBEVB17GG) to understand visits to our public website pages and improve 5K. It receives information about your browser/device, the public pages visited and referring website. Account, billing, project and editing pages are excluded from tagging; page URLs sent by this integration omit query parameters and unknown fragments. Supported campaign labels are sent separately to identify a post or creative variation; personal details must not be put in these labels. We do not send names, email addresses, uploaded artwork or project content as analytics fields. Analytics cookies and your consent preference are configured for up to 180 days. Advertising storage, Google signals and advertising personalisation are disabled.

Google Analytics loads only after you select Analytics and save your choices. Reject optional keeps it off. You can withdraw or change this consent through Legal in the footer, then Cookie settings; withdrawal stops future measurement and removes Analytics cookies in this browser. Essential account cookies are unaffected. Google may process data outside the EEA; see Google’s privacy policy for its processing and safeguards. The reports already collected are not erased automatically when consent is withdrawn.

Optional Pinterest advertising measurement

If you choose Pinterest advertising in Cookie settings, Pinterest tag 2614343156152 receives page visits and confirmed account sign-ups, first successful hosted Motion or Carousel exports, and first Pro purchases. It receives browser network information, including your IP address and browser information, a public page path, a Pinterest ad-click identifier when present, and a random event reference. Purchases may include their verified tax-exclusive value and currency. We do not send email addresses, names, account IDs, payment details, uploaded artwork, project text or unrelated URL parameters.

We use Pinterest’s image-pixel method, without automatic enhanced matching or form scanning. The integration makes no Pinterest request before this separate opt-in, including when JavaScript is disabled. Existing Analytics consent does not enable Pinterest measurement. Your preference lasts up to 180 days; a Pinterest click identifier is kept in a shared-domain cookie for up to 30 days. Event references used to avoid duplicates are kept in this browser for up to one day and in private Studio records for up to 30 days. Confirmed events are available to your browser for up to one day; delivery depends on returning to the Studio, consent and browser privacy controls.

You can change or withdraw the choice above. Withdrawal stops future requests, clears this integration’s optional Pinterest storage and removes pending event records on the next authenticated Studio request. It does not erase reports Pinterest already received or third-party cookies controlled by Pinterest. Pinterest may use the information to attribute conversions, measure or improve advertising and build advertising audiences, and may process it outside the EEA. See Pinterest’s privacy policy for its processing and safeguards.
