5K CREATIVE STUDIO — PURCHASE TERMS

1. Who provides the service

5K Creative Studio is provided by La Porte B.V., Nieuwe Leliestraat 133, 1015 SN Amsterdam, Netherlands. KvK 82417865. VAT NL862463178B01. Contact hello@5k.agency or +31 20 681 1545 for billing, cancellation, withdrawal or complaints. These purchase terms cover the Pro subscription and form part of the Terms of Use. Mandatory consumer rights continue to apply.

2. What you purchase

Pro is a subscription for one named user to create and export motion videos, carousels and banners using the features and output formats described in the plan information when you subscribe. You may create work for yourself and your clients. Uploading and previewing remain free; a verified account and active paid access are required for finished downloads. Team access and annual billing are not included in this launch offer.

Pro includes Motion MP4, Carousel PNG/PDF, and Banners PNG/JPG/MP4 exports in the sizes offered by each editor. Cloud storage allows up to 100 projects and 512 MB per account, with a 64 MB limit per project. Rendering runs in a shared queue with one active render and up to four admitted jobs; a full queue asks you to retry without losing your work. There is no monthly export counter. Download completed files promptly: hosted export links are available for at least 24 hours, after which you can generate a new file from your saved project while Pro is active. Keep copies of your important outputs. Current desktop Chrome is the supported launch browser. Mobile layouts are provided, but mobile devices and Safari are not yet supported for the complete editing and download workflow. We do not promise unlimited storage, unlimited simultaneous rendering or compatibility with every device. We will not charge unapproved usage fees. If a limit prevents an action, the studio will explain the limit and available next steps. Any material paid-plan limits must be stated before purchase, not introduced only after payment.

3. Price, tax and payment

The base price is €9.99 per month, or US$9.99 per month for visitors from the United States, excluding applicable VAT or other transaction taxes. Where required, consumer-facing prices include applicable tax. Before you confirm payment, we show the total recurring price, currency, applicable tax and billing frequency for your purchase. Provide accurate country, billing and, where relevant, business tax information. Business tax treatment depends on the applicable requirements; entering a VAT number alone does not guarantee a tax exemption.

Payments are processed through Stripe. Your card issuer may apply its own currency-conversion or other charges. We do not add a separate card-processing fee. An invoice or receipt identifies the supplier, charge, tax and billing period.

4. Starting Pro and renewal

Pro starts after payment is confirmed and you have expressly requested immediate access. We send a confirmation that you can keep, containing your plan, price and tax, start/renewal details, accepted terms and cancellation/withdrawal information.

You authorise recurring monthly payments at the disclosed price until cancellation takes effect. There is no annual commitment. The next renewal date appears in Billing. The subscription does not begin simply because you upload images or try free previews.

5. Cancelling future renewals

Cancel at any time through Billing → Manage subscription, or by emailing hello@5k.agency. No telephone call or cancellation fee is required. A cancellation received before your next renewal prevents that renewal. We confirm the cancellation and the date your paid access ends.

Ordinary cancellation takes effect at the end of the current paid monthly period. You may continue using Pro until then. Any shorter cancellation period or other mandatory right available under applicable law is unaffected. Cancelling does not itself delete your account, projects or files already downloaded.

6. Consumer withdrawal and refunds

If you subscribe as a consumer, you may withdraw within 14 days of entering the initial subscription contract without giving a reason. We refund the amount paid for that contract, including applicable tax, with no deduction for use or payment-processing fees, even if you have already used Pro or downloaded work. Requesting immediate access does not waive this policy or your statutory rights. Any longer statutory period remains available.

Use the clearly labelled online withdrawal function, email hello@5k.agency, or send a clear statement to our postal address. You may use the supplied model withdrawal form, but doing so is optional. We acknowledge receipt in a form you can keep. Send your notice before the applicable deadline; the request remains valid if our processing takes longer.

We make a valid withdrawal refund without undue delay and within 14 days of receiving the withdrawal notice, normally using the original payment method without a refund fee. Pro access ends when withdrawal takes effect. Your saved projects are not deleted merely because you withdraw.

Outside that withdrawal policy, an ordinary cancellation does not normally produce a proportional refund for an unused part of a month. This does not limit rights concerning defective service, incorrect or duplicate charges, unauthorised payments or any other refund required by law. Business purchases do not receive this voluntary consumer withdrawal policy unless we separately agree; applicable business-customer rights remain unaffected. Contact us about a payment error or service failure so we can investigate and provide the remedy owed.

7. Payment problems and disputes

We may pause new paid exports if a renewal is unpaid or a current payment is fully refunded or disputed. We will explain how to review or resolve the issue through Billing or support. A payment dispute is not, by itself, grounds for deleting your work or denying mandatory rights. Access can resume once the payment and subscription are confirmed as eligible. Any collection, retry or cancellation process must comply with applicable law.

8. Your work and commercial use

You retain your rights in the images, copy and other material you upload. You permit us and our service providers to store and process that material only as needed to provide and support the service, as described in the Privacy Policy. We do not receive permission to publish your work for marketing merely because you use the studio.

You may use and deliver lawfully created exports for personal and commercial projects, including client work. Cancellation does not revoke those output-use rights. You must have the necessary rights in your source material and comply with any disclosed third-party licences. Our sample brand images are for preview/testing unless expressly licensed otherwise. A Pro subscription does not transfer ownership of the studio software or authorise resale of its source templates, fonts or sample assets.

9. Saved projects after Pro ends

Ending Pro stops new paid downloads but does not automatically close your account or erase your projects. We retain saved projects for at least 90 days after paid access ends, unless you request deletion or a legal/security reason requires different handling. Before routine cleanup after that period, we give at least 30 days’ email notice and an opportunity to obtain a portable copy of your work without renewing Pro.

Keep your own copies of important work. This recommendation does not remove our responsibilities for providing the service or protecting data. Account closure, deletion requests and legally required financial-record retention follow the Privacy Policy and applicable law; a subscription cancellation is not a data-erasure request.

10. Changes, service issues and support

We give at least 30 days’ advance notice by email before a price increase affecting your subscription, or longer where required. It applies only to a future billing period after the notice period. You can cancel before it takes effect. We do not apply increases retrospectively or reduce already-paid rights through a silent change to this page.

We maintain the service and required security updates. If we propose a material change that adversely affects your use, we explain it in advance and provide the cancellation, price-reduction or refund rights required by law. If we permanently stop providing Pro, we refund prepaid charges for the unused period and provide a reasonable opportunity to retrieve your work where lawful and feasible.

Contact hello@5k.agency for support or complaints. We aim to reply within two business days, excluding Dutch public holidays. This is a response target, not a guaranteed resolution time. For a service that does not conform to the agreement, we provide the remedies required by law; these terms contain no blanket “as is” disclaimer or “no refunds” exclusion.

11. Applicable law and mandatory rights

Dutch law applies, but this choice does not deprive consumers of mandatory protections available in their country of habitual residence where those protections apply. Nothing here requires a consumer to use a foreign court where applicable law gives them another right. These terms do not exclude liability that cannot lawfully be excluded.
